摘要： 第十一届全国人大常委会审议并通过了《中华人民共和国侵权责任法》,其中医疗损害责任的内容引起了社会各界的广泛关注。可以说这是对我国现有医疗纠纷处理法律制度的完善与重要补充。以此就比较集中的若干问题进行分析和阐述,以期新法可以促进和谐医患关系的构建。

Abstract: The 11th Standing Committee of the National People's Congress adopted the Tort Liability Law of the People's Republic of China.Provisions about medical malpractice liability in this law attracted attention of the society.These provisions of the law are the improvement and supplement to the present system regarding medical disputes.It is believed that judicial explanations will be published soon by the Supreme Court.Problems about medical malpractice liability are discussed,hoping that the new law will help build a harmonious relationship between doctors and patients.
