Abstract: The criminal responsibility of drug-induced mental disorders is not mentioned in our law,and there are disagreements on this issue in the circle of jurisprudence and forensic psychiatry. The main problem focuses on how to assess the criminal responsibility when a drug addict is not able to recognize or control his own act. The author analyzes the evaluation of criminal responsibility of drug induced mental patients from the angle of laws and insists that the evaluation be lack of legal basis and not be good for case treatment when forensic experts take into account of the patients' psychology in evaluation. So it is not appropriate for forensic psychiatry to evaluate the criminal responsibility of drug induced mental patients.
