摘要：  以国务院最近公布的《精神卫生法（草案）》中与鉴定有关的条款为基础，结合司法鉴定学理论与实践，针对术语选用、基础理论与制度设计等问题展开评述与分析，最后提出个人建议。

Abstract:  The State Council recently published the Mental Health Law （Draft）. Some of its provisions are in connection with the forensic appraisal system. The author discusses the issues such as terminology selection， the basic theory and system design， and so on， according to the theory and practice of forensic science. Finally the author gives some recommendations on improving the legislation of the Mental Health Law.
