医疗损害鉴定制度改革构想

Medical damage identification system reform ideas —— in the tort liability law perspective

摘要： 摘要：《侵权责任法》的实施并没有解决我国医疗纠纷鉴定体制的“二元化”问题，医学会医疗事故技术鉴定和司法鉴定机构医疗过错鉴定两种体制并存，不利于医疗纠纷的处理。构建我国医疗纠纷“一元化”鉴定体制，鉴定机构、鉴定人及其管理方式是改革的着手点。由于《侵权责任法》已经确立了“医疗损害赔偿”的术语，故鉴定名称应改为“医疗损害技术鉴定”。从充分利用现有鉴定资源和两种鉴定体制优势理念出发，应由医学会牵头组建“医疗损害技术鉴定机构”，其“鉴定人”由符合全国人大常委会《关于司法鉴定管理问题的决定》所规定的条件的医学、药学、法医学专业技术人员中经本人申请择优选用，司法行政机关对其进行行政管理，卫生行政机关和医学会对其进行行业管理，并在现行鉴定制度的基础上吸收完善鉴定程序，增加鉴定内容。

Abstract: Abstract: the tort liability law implementation does not solve the medical dispute appraisal system "thus" problem, medical association medical accident technical appraisal and judicial authentication institutions medical treatment fault identification two system, both to the processing of medical disputes. Constructing China's medical disputes "unified" appraisal system, the appraisal institutions, appraiser and the management way is to reform the key points. Because of the tort liability law has established "the medical damage compensation" terms, the name of the appraisal should be changed to "technical appraisal of medical damage". Make full use of the existing resources from identification and two types of appraisal system advantage based on concept, should by medical association lead form "medical damage technical evaluation institutions", its "expert" by conform to the National People's Congress standing committee on the management of judicial authentication decision "the provision of the medical and pharmaceutical, forensic medicine professional and technical personnel to my application for the select judicial administrative organ of the administrative management, public health administrative organs and the medical industry management, and in the current identification system based on the absorption of perfect appraisal procedure, increase the appraisal content.
