Abstract: The author analyzed and discussed the problems of "dualization " model existing in the judicial authentication on medical malpractice in China's current forensic medicine and the necessity of building "unified" appraisal model from the aspects of legality, impartiality and honesty. Then the authors proposes the possibility to establishment of "unified" appraisal subject, appraisal methods and appraisal system to ensure scientific nature and impartiality of the judicial authentication for medical malpractice.

摘要： 本文对我国目前医疗损害司法鉴定“二元化”模式存在的问题进行了深入的分析和讨论，并从合法性、公正性和科学性方面初步探讨构建医疗损害司法鉴定“一元化”鉴定模式的必要性，进而提出建立“一元化”的鉴定主体、鉴定方法和鉴定制度的可能性，确保医疗损害司法鉴定的科学性和公正性。
