Abstract

摘要： 党的十八届四中全会提出依法治国方略，十九大报告强调要全面依法治国。在此背景下，如何加强司法鉴定救助制度建设、完善司法体制，就成为理论界和实务界有识之士思考的重要课题之一。司法鉴定救助制度的构建对于司法权威的提高、当事人诉讼权利的保障、司法鉴定社会公益性目标的实现等均具有重大意义。当前，我国司法鉴定救助制度还存在立法不够完善、救助资源不够充足、救助对象和范围较窄等问题。建立、健全司法鉴定救助制度，必须坚持一定原则，采取统一立法的方式，细化立法内容，强化监督管理。
