Abstract: In litigation procedure, besides examining and determining the validity of evidence, the parties and trier of facts need to determine whether the evidence is objective and has related to the facts examined, that is, to determine the force of the evidence. This article analyses the relationship between validity of evidence and its force, the necessity to examine and determine the force of forensic appraisal conclusions from the aspect of litigation, by using evidence law, procedural law and theory of forensic science.

摘要： 在诉讼活动中,当事人和事实裁判者除了要审查证据的合法性即证据能力之外,还需要确认证据本身是否具有客观性以及与待证事实是否具有关联性即证据证明力。本文通过综合证据法学、诉讼法学和司法鉴定理论,从诉讼应用的角度,对证据能力与证明力的关系、司法鉴定结论证明为审查判断的必要性进行阐述,并进而提出初步的审查方案。
