摘要:

随着汽车相关案件频发和媒体的高度关注,汽车电子数据鉴定逐渐成为电子数据鉴定的热点方向。通过分析汽车电子数据鉴定的典型需求,将其分为事故调查、痕迹溯源和功能鉴定三类。结合汽车电子数据鉴定的技术标准和鉴定工具,系统性地介绍了汽车中具有证据价值的电子控制单元、事件数据记录系统、车载信息娱乐系统、汽车行驶记录仪、汽车行车记录仪等主要电子数据的来源,以及相对应的电子数据提取方法。结合司法鉴定工作实务,提出一种改进的汽车电子数据鉴定通用框架,介绍了两个具有代表性的鉴定案例,为相关从业人员提供理论支撑和操作指导,并对汽车电子数据鉴定的难点及发展方向进行展望。

Abstract:

With the frequent occurrence of automobile related cases and the high attention of the media, automotive electronic data appraisal has gradually become a hot direction of electronic data appraisal. By analyzing the require ment of automotive electronic data appraisal, the typical requirements of appraisal are divided into accident investigation, trace tracing and function appraisal. Combined with the technical standards and appraisal tools of automotive electronic data appraisal, this paper systematically introduces the sources of main electronic data with evidence value in automotive, such as Electronic Control Unit (ECU), Event Data Recorder (EDR), In-Vehicle Infotainment (IVI), Vehicle Traveling Data Recorder(VDR) and dashboard camera, as well as the corresponding electronic data extraction methods. Combined with the practice of forensic appraisal, this paper puts forward an improved general framework of automotive electronic data appraisal, introduces two representative appraisal cases, provides theoretical support and operation guidance for relevant practitioners, and looks forward to the difficulties and development direction of automotive electronic data appraisal.
