Research on the Integration of Forensic Appraisal Practice and Forensic Education in China

Abstract: Forensic appraisal is a complex and interdisciplinary field. The classification system of forensic appraisal practice is so complicated that it is divided into four sections: forensic medicine, forensic examination of physical evidence, forensic audio/video examination, and forensic environmental damage examination. In other countries, the system of forensic appraisal practice organizations ordinarily is divided into two types: disperse type dominated by private entities and concentrate type dominated by the government. But their classification system of forensic appraisal practice resembles the counterparts in China. In China, the institutions of forensic education are police colleges, law colleges, medicine colleges, and some STEM colleges. The forensic education has two forms, including academic education and professional training. The forensic education programs contain five parts: jurisprudence and law, fundamental STEM, forensic sciences, forensic laboratory, forensic casework and practice. The integration of forensic appraisal practice and forensic education requires certain conditions. The integration of the two sections in China has formulated its patterns and some experience has been attained. In order to deeply integrate the two sections, it should promote the progress of forensic vocational education, specialization of the colleges education, the marketization of forensic appraisal, and deepen the integration of forensic appraisal practice and forensic education.

摘要: 司法鉴定是一个复杂的跨学科领域。司法鉴定执业分类体系较为庞杂,我国主要将其分为四大类:法医类、物证类、声像资料和环境损害。其他主要国家的司法鉴定执业体制一般分为:社会司法鉴定机构为主体的分散制和以政府司法鉴定机构为主体的集中制,其执业分类与我国大同小异。我国司法鉴定教育主体是公安院校、政法院校、医学院校和部分工科院校,教育形式主要为学历教育与专业培训两大板块,课程设置体系包括:法学类课程、基础自然科学类课程、司法鉴定专业类课程、司法鉴定实验类课程、司法鉴定案件分析实训类课程。司法鉴定实践与教学融合有其必要条件。我国在司法鉴定领域的实践教学融合,已有一定模式并获得了一些经验。司法鉴定实践教育深度融合,应当着眼于进一步推动司法鉴定的高职教育,推动普通高校的专门化,推动司法鉴定的进一步市场化,推动司法鉴定执业和教育环节彼此深度渗透。
