Abstract: Sunlight is the best antiseptic; sunlight makes judicial authenticion procedure open and transparent. However,the core of judicial authentication is science and technology. The outside interference on forensic experts should be minimized. So,in the process of judicial authentication,refration of sunlight is better than direction. In this way,the right of the party concerned are guaranteed,and the eyes of forensic experts are protected from direct glare.

摘要： 阳光是最好的防腐剂,增加通光量会使鉴定程序更加公开与透明,这也是司法鉴定改革趋势与方向。但司法鉴定的核心是科学技术,必须考量减少外界"噪音"对鉴定人的干扰,因此在"鉴定阳光"射入方式上,如果说鉴定前与鉴定后阳光应当直射,那么鉴定中阳光则折射优于直射,这样既充分地保障当事人诉讼参与的权利,同时也保障了鉴定人无"刺眼"的鉴定环境。
