Abstract: In view of the dilemma often encountered in the practice of forensic psychiatry appraisal, this paper reviews the historical context of forensic psychiatry, sorts out and clarifies the role and responsibility of forensic psychiatrists, which is quite different from clinical psychiatrists, and makes a preliminary discussion on the value orientation and ethical principles in forensic psychiatric practice. On the premise of acknowledging the basic scientific attributes of forensic psychiatry, exploring the truth should be the first value pursuit. Besides, considering the interface of law and psychiatry, seeking both truth and goodness should be established as the overall value orientation for forensic psychiatrists. The whole process of forensic psychiatry appraisal should be checked by a specific set of ethical principles, and the optimal solution should be determined within a framework of dialectical principlism.

摘要： 针对法医精神病鉴定实务中常遇两难困境，在回顾梳理法医精神病学科历史脉络基础上，明确有别于临床精神科医师的法医精神病鉴定人角色与责任，并就法医精神病鉴定人价值取向与伦理原则作出初步探讨。在承认法医精神病学基本科学属性前提下，以求真作为第一价值追求，并结合其与法学交叉性质，确立求真亦求善的总体价值取向。将法医精神病鉴定工作全流程置于本专业特有伦理规范体系内，在辩证原则主义分析框架下寻求各种困难情形处置的最优解。
