新《刑事诉讼法》有关鉴定规定几个重点问题的理解

Abstract

摘要：

全国人大新修正的《刑事诉讼法》有关鉴定问题的规定有近二十处，其中保留条款八处，新增条款七处，个别修正条款二处，删掉条款一处。从与鉴定相关法律法规的精神和司法鉴定理论与实务角度，对新条款中几个难以理解或理解上容易出现分歧的重点问题，发表一些粗浅认识和提出一些在执行中需要考虑的措施，供有关方面参考，期望新《刑事诉讼法》在确保刑事鉴定为惩治犯罪、尊重与保障人权方面发挥应有的作用。
