To Consolidate and Deepen the Achievements of Forensic Appraisal Reform through Legislation

摘要: 司法鉴定立法须找准司法鉴定行业发展的“难点、痛点”,并通过分析这些问题的深层原因,从而寻找问题的突破口。推进统一司法鉴定管理体制改革进程面临瓶颈,一定程度上制约统一司法鉴定管理的边界、权责、手段和效果,立法滞后是其中主要的制约性因素。促进和推进司法鉴定统一立法要抓住“统一”这个关键词,制定统一规范司法鉴定事业和行业发展、契合统一司法鉴定体制改革决策逻辑的专门性法律。在统一立法中要先厘清界定、科学分配司法鉴定管理职权,特别是解决好司法鉴定“谁来管理”“管理什么”“如何管理”三大问题。可考虑统一按照鉴定对象的属性来划分鉴定大类,整合划分法医类、物证类、会计评估类三大鉴定类型,授权司法行政部门适时动态调整并发布司法鉴定执业分类目录及项目。

Abstract: The legislation of forensic appraisal management must find out the difficulties and problems in the development of forensic industry, and analyze the causes thereof, so as to seek the way forward. We are facing some bottleneck problems in promoting the unified forensic appraisal management system. To some extent, these problems restrict the boundary, right and responsibility, measures and effects of the unified forensic appraisal management. Laggardness of legislation is the critical limiting factor. To boost and accelerate the unified forensic appraisal legislation should focus on the key word of “unified”, stipulate the special law which can uniformly regulate the industry and the development of forensic appraisal, and accord with the logic of the unified forensic appraisal management reform system. In the process of unified legislation, we should clearly define and scientifically allocate the administrative power of forensic appraisal management. Especially, we should solve the three main  issues of forensic appraisal regarding “who to manage”, “what to manage” and “how to manage”. We may consider, according to the natures of forensic objects, to divide the forensic appraisal disciplines into three branches: forensic medicine, forensic physical evidence and forensic evaluation of accounting. The judicial administrative departments should be authorized to dynamically adjust and publish the catalogues and items of forensic appraisal practice in due time.
