Abstract

摘要：

专家证据是由熟悉某专业或经过对该领域的特殊培训而有资格作证的人提供的科学技术、专业或其他专业问题的意见证据。基于专家证据形成和内容的专业性、科学性而就相关专门问题有着较强的证明力，但由于其所涉及的专业知识为一般常识所无法包容，致使专家证据的评价和采信存在难点。英国专家证据的评价和采信通过证据开示和交叉询问程序加以实现，其专家证据评价与采信规则的发展，为面对现代专家证据或鉴定意见评价存在的类似挑战和问题时提供尝试的例证，且其发展的逻辑和规律对我国鉴定意见的质证具有一定的借鉴意义。
