    Rules of Admissibility of Appraisal Opinions

    Based on different values, admissibility as evidence of appraisal opinions can be divided into types of substantive reality and procedural justice. Analyzing the existing relevant rules of evidence with the theoretical framework, we find that there are some flaws. Therefore, this paper designs the systematic rules of admissibility as evidence of appraisal opinions.

    The Reform of Forensic Appraisal in China

    The reform of forensic appraisal in China started in 1998. The first round reform was led by the Ministry of Justice. Its central content was the socialization and the system unification of forensic appraisal. The benchmark of the second round reform was “the Decision on Issues of Forensic Appraisal Administration” issued by the Standing Committee of the National People’s Congress. Its goal was still the unification of the forensic appraisal system. But now the broadly questioned problem of multiple appraisal and repeated appraisal still exists. We should deepen the reform from some aspects, such as the drafting of the Forensic Appraisal Law, the unification of the administrative system of forensic appraisal, the parties’ participation in forensic appraisal and the improvement of the administration system of forensic appraisal.

    Forensic appraisal is an important means for guaranteeing the genuineness, lawfulness and validity of evidence in litigation and plays an important role in assisting judicial fairness, efficiency and authority. However,forensic appraisal meets some problems in practice, such as the low ratio of the appraiser appearing in court, the long time for forensic appraisal, the unsettled standard of appraisal charge, and the limited forensic appraisal technique. Aiming at resolving these problems, the efficiency of forensic institutions should be improved, the system of the appraiser’s appearance in court should be perfected, appraisal standard should be unified, and the cooperation between forensic institutions and courts should be tightened.

    The frequently seen tragedies regarding psychosis bring more and more concern in our country. One of the fundamental reasons why such tragedies happen is that a great part of psychopaths and suspected psychopaths are not evaluated, so are not well treated and given proper guardianship. The lack of related legislation leads to the consequence that people do not have the consciousness and action to start the evaluating process. So we need to establish a system which contains the scope of application, the initiation body, the requirements of delegation and application for evaluation as well as the fee.

    On the basis of comparative researches on approximately 50 sets of image processing software, image measuring software and measuring system, an integrated technical platform for measuring, comparing and quantitative analysis of printed features is established in view of forensic printed document examination practice. Preliminary application of quantitative feature analysis in printed document examination is introduced.

    Classification toners of Laser Printers with Micro Raman Spectroscopy

    Objective To differentiate toners of laser printers using micro Raman spectroscopy. Method 30 samples printed by 8 brands and 25 toner models of laser printers were analyzed with 785nm excitation wavelength in line focus mode and 50X objective. Result According to characteristic peaks of different molecular functional groups, 30 samples could be divided into five categories. Conclusion Micro Raman spectroscopy could classify toners of different types of laser printers.

    Defining the cultural connotations and the core culture value in forensic appraisal, and exploring the position and effects of forensic appraisal culture, this thesis aims at forming an interpretation of the culture in forensic appraisal. It figures out that the self-discipline mechanism in the culture of forensic appraisal plays an important role in guaranteeing the quality and public credibility of forensic appraisal. Therefore, the theoretical discussion of cultural molding in forensic appraisal has significant practical meanings.

    With the implementation of the Tort Liability Law, the forensic appraisal in medical disputes will play a more and more important role in medical injury identification. There exists a dual system of medical injury identification, which has its advantage and disadvantages. It is necessary to establish a uniform and independent system of medical injury identification. It’s of positve significance for protecting the legitimate rights and interests of doctors and patients, settling medical injury cases fairly according to law and constructing a hamonious doctor and patient relationship.

    Forensic toxicology concerns the analysis of biological specimens for the presence of drugs and poisons to determine what role the detected substances play in death or impairment of human performance. The interpretation of the results is the ultimate purpose of forensic toxicology. Modern forensic toxicology consists of three major areas: post-mortem forensic toxicology, forensic urine drug testing, human-performance forensic toxicology. This article discusses various factors that enter into the interpretation process in each area. The results must be interpreted with caution. Apart from the measured concentrations, many affecting factors like data from autopsy and investigation, drug toxicity, types of biosamples, pharmacokinetics, redistribution, and drug interactions should be taken into full consideration so that accurate result interpretations could be achived in cases.

    Determination of Cantharidin in Biological Samples by Solid Phase Extraction-Gas Chromatography Method

    Objective To develop a solid phase extraction-gas chromatography method for the determination of cantharidin in biological samples. Methods Samples were purified by using HLB solid phase extraction column and detected by gas chromatography with internal standard added. Results The recovery rate of cantharidin in biological samples ranges from 93.03% to 98.29%, the limit of detection is 0.05μg/mL. The method showed excellent linearity (the linear correlation coefficient is 0.9990). Conclusion The method could be applied in forensic toxicological analysis of cantharidin in blood and urine samples with the advantage of simple and quick operation, high recovery rate, good repetition and clean extraction.

    Forensic accounting has just been introduced into China from countries under the Anglo-American legal system in recent years. Nowadays in China, there exist various misunderstandings on the research of forensic accounting theory, the lack of institutional practice of forensic accounting and the discrepancy between personnel training and market demand. Forensic accounting is different from judicial accounting in that they are based on different judicial systems and litigation modes. The study and practice of forensic accounting must be conducted according to China’s basic condition and be adapted to the specific litigation and evidence system and the judicial administrative system.
