摘要：

虚拟治理成本法作为一种常用的环境价值评估方法，对于环境污染责任追究工作发挥着重要作用。通过系统梳理虚拟治理成本法相关定义、适用范围以及评估流程，并对2014—2020年期间（以裁判日期计）国内典型相关案例从时间分布、地域分布、污染物类别及环境受体、鉴定机构情况等方面进行研究，梳理该方法的实践应用情况，总结我国虚拟治理成本法在鉴定实践过程中的经验与问题所在。针对存在问题中涉及的关键环节进行充分讨论并提出进一步完善环境损害司法鉴定中虚拟治理成本法技术实践的对策建议，对于不断优化与规范该方法的应用以及完善环境损害司法鉴定技术体系具有重要意义。

Abstract:

As a common environmental value evaluation method, virtual governance cost method plays an important role in the investigation of environmental pollution liability. This paper systematically sorts out relevant definitions, application scope and evaluation process of the virtual governance cost method, and analyzes the time distribution, regional distribution, pollutant categories, environmental receptors and appraisal institutions of typical domestic cases from 2014 to 2020 (based on the judgment date), so as to sort out the practical application of this method, summarize the experience and problems of China’s virtual governance cost method in the process of appraisal practice. The key links involved in the existing problems are discussed, and the countermeasures and suggestions to further improve the technical practice of virtual governance cost method in the judicial practice of environment damage are put forward, which is of great significance to continuously optimize and standardize the application of this method and improve the forensic appraisal technology system of environment damage.
