    Evidence Theory Revolution and Forensic Expertise—In the Angle of Criminal Evidence

    Abstract ( )  
    Evidence is the substantial carrier containing case information. Evidence can be classified into two categories, one is the witness evidence, and the other is the physical evidence. Evidence is the integration of external formation and internal meanings. The evidence formation is stable and can be used for the identifying symbol, while the evidence meaning is variable and not suitable for the identifying symbol. Therefore, the type of evidence should be distinguished by the evidence formation. Case information that is reviewed and accepted by courts is the basis attesting case facts. Most physical evidence needs to be authenticated through forensic expertise in order to extract case information.

    The concept, contents and methods of expert testimony in court for forensic medical examiners are introduced, and the value of forensic conclusions and quality requirement for forensic medical examiners are discussed. It is concluded that only the examiners with high quality can take the forensic examination task in the new century and succeed in the expert testimony in court.

    Several Legal Issues of the Retention for Forensic Medical Examination

    Abstract ( )  
    Retention for forensic medical examination is a measure to retain the defendant in a hospital or other places to identify his/her mental or physiological status. The existence of the retention is closely related to the development of forensic medicine, and in a sense, the immaturity of forensic medicine is the existing soil for the retention. Retention for forensic medical examination itself is an action affiliated to compulsive examination. It is part of the investigation process, not a punishment. Retention for forensic medical examination is the natural result of compulsive examination, which restricts the freedom of the defendant to some extent, and therefore should be subjected to the judicial review. Compulsive examination is an independent compulsive measure. It does not restrict defendant’s freedom so hard as custody. Besides, it may result in the reduction or exemption of the criminal liability of the defendant. Therefore, the duration of the retention for forensic medical examination under judicial review should be excluded from the custody period.

    Objective To develop a method for the simultaneous identification and quantification of THC, CBN, CBD and the major metabolite THC-COOH in urine samples. Methods Urine samples were hydrolyzed with sodium hydroxide, and deuterium-labeled THC-COOH (Δ9-d9-THC-COOH) was added as internal standard; then the solution was extracted with n-hexane-ethyl : acetate(9:1), dried, solved with 100μL acetonitrile, and analyzed by liquid chromatograph coupled to tandem mass-spectrometry (LC/MS-MS). Results The limits of detection for THC-COOH, CBN, THC, CBD were 0.2, 0.4, 1.0, 2.0ng/mL; THC-COOH was detected in the positive samples,with a concentration of 335.9ng/mL. Conclusion With this method, CBD,CBN,THC and their major metabolite THC-COOH in urine samples could be detected simply, quickly, sensitively and exclusively during toxic analysis.

    Live Analysis on-Scene to Collect "Volatile Digital Evidence" in Running Computers

    Due to lack of computer forensics professionals, the "two-steps" approach is commonly adopted to gather digital evidence in the running computer at the crime scene, that is, unplugging the running computer and booking it into evidence facilities first, then submitting it to trained digital evidence experts for examination. Although this method protects the aboriginality and integrity of digital evidence, it leads to the loss of "volatile data" stored in RAM and in other forms. The "volatile data" can often provide crucial clues and evidence for crime investigation, so it is necessary to make live analysis on-scene to acquire them. It is recommended that investigators be given professional trainings and get the live analysis skill.

    Cases relating to civil competence assessment for mentally disordered persons are increasing, but researches on this issue are inadequate and confusions about the definition and grading of civil competence exist among forensic psychiatrists. In the paper, definitions of civil competence are discussed and compared with that of capacity to action. Different opinions on the grading of civil competence are introduced. It is proven that, according to related law and rules, practice and realistic significance, civil competence should be classified into three grades.

    The X-ray plate is applied mostly to observe the emergence of subsequent ossification center and to deduce age using image characteristics of epiphyseal arrest level. There are many methods that are based on the X-ray plate to estimate living body age, such as the counting method, measuring method, mapping method, scoring method, computer-assisted method, and etc. The TW scoring method is generally adopted aboard. It is also reported in China and used in sports and paediatric clinical practice. In forensic medicine, the discriminant equation based on six major joints is widely used to estimate bone age and living body age. Other techniques are sometimes applied in estimation of age, concerning the racemation of aspartate in teeth, bone density and alteration of telomere termination fragment length.

    objective To apply and evaluate two different kits-- Identifiler and Sinofiler in paternity testing of Chinese Han population. Methods By multiplex amplification system, capillary electrophoresis and GeneMapper typing, 15 STR loci were genotyped in 106 cases of paternity testing. Results In inclusive cases, Sinofiler has higher PI valves than Identifiler; in exclusive cases, Sinofiler is more effective than Identifiler. Conclusion The results show that Sinofiler is more suitable in Chinese Han paternity testing.

    The revealing effect of obliterated scripts was studied using self-prepared dialysis solution. Eight influencing factors, such as the manner of obliteration, the thickness of obliterating layer, the thickness of dialysis solution, and so on, were discussed. The result of the study can be used for reference to improve the revealing effect in practice.

    Up to now, the theory of questioned document examination has grown mature, but in practice, how to find valuable characteristics is still a challenging task for examiners and needs summarizing constantly. Pen pressure is a kind of characteristics frequently used in handwriting comparison; at the same time, it can also be applied in examination of addition alteration. In the paper, two cases involving the application of pen pressure characteristics are presented; the observation method of pen pressure is introduced and points of how to utilize the characteristics are discussed.

    The knife is a common tool in daily life, and at the same time, is one of the most frequent weapons in crime. Locating and identifying criminal suspects by inferring the type of knives is a widely adopted approach in crime investigation. From the view of knife industry, the functions, structural features and manufacturing materials of standard style knives are studied. In the aspect of forensic examination, the shapes and characteristics of traces left by standard style knives are analyzed, and the inferring method is discussed.
